Is it Spring yet—or are we still stuck in that unpredictable, can’t-decide-if-it’s-winter-or-spring kind of weather?

This time of year tends to feel the same way in schools. By now, the patterns are harder to ignore—some good, and some raising real concerns.

If your child isn’t making the progress you expected, or things seem to be getting harder instead of easier, you’re not alone. This month, we’re focusing on what it means when a program simply isn’t working—and what schools are required to do about it.

We break down when more intensive placements, including residential programs, may need to be considered, along with common roadblocks families face when asking for change.

Residential Placement: When “Last Resort” Becomes Legally Required

Residential placement is often described as a “last resort.”

Districts rely on that phrase to delay, deflect, and deny. But legally, that framing is incomplete.

The question is not whether residential placement is extreme. The question is whether it is necessary for a child to receive a Free Appropriate Public Education (FAPE).

If it is necessary, the district must consider it. Period.

Residential placement becomes appropriate when a student’s needs are so significant that they cannot be met in any day program, even with substantial supports. This is not about preference or convenience. It is about access to education.

Key indicators include:

• The student cannot retain skills across environments

• Behavioral or emotional needs are constant, not limited to school hours

• The student requires 24-hour structure, consistency, and intervention

• Repeated failures across multiple placements despite increasing supports

A common pattern is escalation. The student starts in a less restrictive setting, struggles, receives added services, continues to deteriorate, and is moved again. Eventually, the system runs out of day options. At that point, districts often stall, offering more of the same instead of acknowledging what the data already shows.

Residential placement is not about removing a child from home. It is about providing the level of support required for the child to access education meaningfully. If a student cannot make progress because their needs extend beyond the school day, then limiting services to school hours is a denial of FAPE.

Another critical point: districts cannot refuse residential placement based on cost. Financial considerations are not a legal defense.

Parents are often told:

• “We don’t do that here”

• “That’s too restrictive”

• “Let’s try one more program”

These are delay tactics. The law does not require a child to fail indefinitely before the district acts.

If the data shows that less restrictive settings have not worked, the obligation shifts. Residential placement is no longer a last resort. It becomes the appropriate placement.

Programs do not fail overnight. They fail gradually, and the warning signs are usually clear long before the district acknowledges them.

The problem is that schools often normalize failure. Lack of progress is reframed as “slow growth.” Escalating behavior is labeled “part of the disability.” Frequent removals are treated as isolated incidents.

None of that changes the legal standard.

A program is no longer appropriate when it cannot meet a child’s needs in a way that allows for meaningful progress.

Watch for these indicators:

• Regression: Skills that were previously mastered begin to disappear. This is not a plateau. It is a clear sign the environment is not working.

• Lack of Measurable Progress: If progress reports are vague, inconsistent, or unchanged over time, that is not progress. It is documentation of stagnation.

• Escalating Behaviors: An increase in intensity or frequency of behaviors often signals unmet needs, not defiance. If interventions are not reducing behavior, the placement may be wrong.

• Frequent Removals: Suspensions, early pickups, shortened days. These are not discipline issues. They are evidence that the program cannot support the student.

• Increased Restriction Without Results: Adding more services to a failing program is not the same as changing the program. If supports are layered on and nothing improves, the issue is the placement itself.

Districts often respond by tweaking services instead of reevaluating placement. That approach delays real solutions and prolongs failure.

Parents should not wait for a formal admission that a program is inappropriate. By the time the district says it out loud, the child has already lost time.

When the data shows that the current placement is not working, the district has an obligation to act. Not later. Now.

This is one of the most common and most misleading statements parents hear.

Districts are not limited to the programs they currently operate. They are legally obligated to provide an appropriate placement, even if that means:

• Contracting with an outside provider

• Placing the student in an out-of-district program

• Creating a program that does not yet exist

The law does not allow a district to deny services because they are inconvenient or unavailable internally.

If the district cannot meet the student’s needs, it must find someone who can.

“We don’t have that program” is not an explanation. It is an admission.

Home instruction is often presented as a solution. In many cases, it is not.

Short-term home instruction can be appropriate for medical or transitional reasons. The problem arises when it becomes a default placement for students who cannot be managed in school.

Warning signs include:

• Indefinite extensions without a clear plan to return to school

• Minimal instructional hours

• Lack of related services

• No meaningful progress monitoring

Home instruction is one of the most restrictive settings. It isolates the student and often provides significantly less instruction than a school-based program.

It should not be used as a holding pattern while the district avoids making a placement decision.

If a child is on home instruction because no appropriate program has been identified, that is a failure of the district’s obligation.
