Janaya S. Kerben, Esq.

Of Counsel

Janaya S. Kerben focuses her practice on Special Education Law. Her dedication to advocating for students with disabilities is deeply personal, shaped by her own experience struggling in school and her lifelong commitment to ensuring that children facing similar challenges receive the support they deserve.

Ms. Kerben has volunteered and worked with children and adults with disabilities since childhood, grounding her practice in years of service to the special needs community. Coming from a family of attorneys, she is proud to continue the legacy of her late father, a respected Criminal Defense and Immigration Attorney, alongside other family members who also practice law in New York.

Ms. Kerben represents parents and families in special education administrative hearings under the IDEA, including due process and pendency proceedings, tuition reimbursement matters, equitable services cases, and appeals to the SRO. She is especially dedicated to safeguarding the rights of low-income and Spanish-speaking families. She also maintains her own practice, Kerben Law, PLLC.

In addition to special education advocacy, Ms. Kerben has experience in Immigration and Criminal Defense Law, representing immigrant children and families in benefit applications and removal proceedings across multiple states. She is fluent in Spanish.

Ms. Kerben is admitted to practice in New York State and the U.S. District Court for the Eastern District of New York, with admission pending in New Jersey and the Southern District of New York. She earned her J.D. from Touro College Jacob D. Fuchsberg Law Center, concentrating in Elder and Special Needs Law, and holds an MBA in Health Care Administration. She is also pursuing a Master’s in Education and Special Education.

An active community advocate, Ms. Kerben provides pro bono legal support to organizations including Advocates for Children (AFC), Kids in Need of Defense (KIND), Agudath Israel of America, Torah Schools for Israel, the Jewish Community Council of Greater Coney Island, and the NYU Suspension Representation Project.

Outside of the courtroom, Ms. Kerben resides in Great Neck, NY, enjoys playing tennis, and continues her extensive volunteer work with special needs programs, rehabilitation centers, hospitals, and community organizations. She is also a guest speaker and mentor, a member of the Nassau County Bar Association, and remains deeply committed to service, family, and personal growth.
